1. Agreement to Terms

By accessing or using NeedAnAd.com (the "Service"), you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

2. Services Provided

NeedAnAd provides an automated platform for generating audio adverts and jingles using third-party artificial intelligence providers. We grant you a non-exclusive, non-transferable right to use the Service strictly in accordance with these Terms.

3. Commercial Rights and Usage

Upon successful generation during an active paid subscription or qualifying purchase, you are granted full, perpetual commercial rights to use the final audio files ("Output") for your business purposes, including broadcasting, online advertising, television, radio, and social media. These commercial rights survive any future cancellation or expiration of your subscription—any audio created while subscribed remains yours to monetize and broadcast forever. NeedAnAd retains the non-exclusive right to use generated Output as anonymous promotional samples on our platform unless explicitly requested otherwise.

4. User Responsibilities

You agree not to use the Service to generate content that is illegal, defamatory, hateful, or infringes upon the intellectual property rights of others. We reserve the right to terminate accounts that violate these guidelines without refund.

5. Payments and Subscriptions

Our Service is billed on a subscription basis or via one-time payments through our payment processor (Stripe). Subscriptions automatically renew unless canceled prior to the end of the current billing cycle. Under EU consumer protection law, you may have the right to withdraw from a subscription within 14 days, provided you have not utilized the service to generate audio within that period.

6. Third-Party AI & Cloud Services

The Service relies on proprietary production pipelines and trusted third-party artificial intelligence synthesis engines to generate script text and commercial audio. We are not responsible for subjective artistic variations in the generated Output, nor any temporary service latency caused by upstream cloud infrastructure providers.

7. Limitation of Liability

To the maximum extent permitted by applicable law, NeedAnAd shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the European Union, without regard to its conflict of law provisions.
